BrandLoyalty has announced that the European Patent Office (EPO) has dismissed all objections against granting BrandLoyalty patent number EP3071485B1 which covers a flowpack packaging technique - formally ‘the form fill seal procedure for packaging articles in bags filled with air'. 

's Hertogenbosch, the Netherlands – September 20, 2022 – BrandLoyalty, the leading provider of campaign-based loyalty campaigns, has today announced that the European Patent Office (EPO) has dismissed all objections against granting BrandLoyalty patent number EP3071485B1 which covers ‘the form fill seal procedure for packaging articles in bags filled with air’. 

Invented in 2013, the packaging technique is now exclusively BrandLoyalty’s property. BrandLoyalty uses this technique to pack e.g., figurines that are used as rewards in loyalty campaigns. The air-filled bags allow BrandLoyalty to safely pack loyalty rewards and act as a ‘surprise product’, meaning shoppers can’t recognize the article without removing the package.

After purchasing the patent in 2015, BrandLoyalty went through several patent battles, after which the EPO’s Board of Appeal decided in favor of BrandLoyalty on May 4th, 2022. For the next 15 years in Europe, BrandLoyalty has the exclusive right to use the patented technique and demand compensation from anyone who has applied the described packaging method without BrandLoyalty’s prior approval since 2017.
